In the process of constitutionalisation of transnational organisations norms transfers occur when the connotations of domestic norms move into a beyond-the-state setting. As norms are both constructive and constructing, the move takes them out of their socio-cultural community which creates a degree of contestation but yet retain their importance. Building on this facticity/validity tension, is it possible for EU’s CFSP to be characterised as a life-world beyond-the-state? And how does the process of constitutionalisation affect the diffusion, convergence and divergence of core constitutional norms in a comparative aspect between elite groups at EU’s CFSP and Germany, Sweden and the UK?
