My research involves examining the role of the law in the protection of children with mental and intellectual disabilities in Nigeria. Every human being, regardless of age, gender or ability has certain enforceable Human Rights protected by both Domestic and International law. It is the duty of the state to provide legal protection of those rights. Where violation occurs, redress may be accessed through civil or criminal proceedings. The research examines legal provisions in Nigeria that establish, protect and implement the right of protection of children with mental and intellectual disabilities from violence and abuse and mechanisms put in place to ensure enforcement of legal provisions in compliance with state obligations. The concept of Justice applied and the impact of Legal pluralism on this protection in Nigeria which is a multi-ethnic, multicultural, multi-religious and economically diverse Federal State with three tiers of government are also examined.
