Kathryn McNeilly

Dr Kathryn McNeilly

(Feminism, Human Rights, Critical Legal Theory)

Feminist Judgements: From Theory to Practice: Edited by Rosemary Hunter, Clare McGlynn and Erika Rackley - This book compiles ‘missing’ feminist judgments in key cases (primarily opinions of the Court of Appeal or the House of Lords) written by a group of feminist legal scholars.

Northern/Irish Feminist Judgments: Judges Troubles and the Gendered Politics of Identity: Edited by Máiréad Enright, Julie McCandles and Aoife O’Donoghue - A collection of 26 re-written judgments; using a feminist perspective this book explores cases heard throughout the island of Ireland, including a fictional review of a Tribunal of Inquiry.

While these books are separate books they can be read together as they both stem from ‘feminist judgments projects’. These projects can be found in many legal jurisdictions including Canada, India and the United Kingdom. The projects involve feminist academic and practicing lawyers collaborating on case law and the role of the judge on decision-making in cases and the role that gender may play in legal decision-making. Both books include themes of feminism, critical legal theory, identity, justice.

If you are interested in Feminist Judgment projects see the following for further reading The Feminist Judgments Project (UKSC blog)  Scottish Feminist Judgements Project The Women's Court of Canada and Indian Feminist Judgment Project.
