From Validity Challenges to Estoppel - Principles, Pitfalls and Practical Solutions
All types of estate dispute have been on the increase in recent years, including validity disputes (lack of formality, incapacity, knowledge and approval, undue influence, forgery and fraudulent calumny), claims on foot of the Inheritance (Provision for Family and Dependants) (NI) Order 1979 and proprietary estoppel. This seminar gives an overview of validity disputes, inheritance claims and proprietary estoppel - a reminder of the basic principles governing each and an update on case law as well as dealing with procedural
issues such as time limits and the peculiar difficulties of mediating a multi-party estate dispute (including the need to consider taxation and other fiscal implications). While this seminar will be of interest to all those working in this area, it is designed in particular for less experienced practitioners who wish to develop their interest in the burgeoning area of estate disputes.
Speaker
Sheena Grattan
The seminar will be delivered by Sheena Grattan BL, TEP (retired). Sheena has published widely in this area and dealt with this type of dispute on a daily basis during over 20 years as a practising barrister. She is a founding member of the STEP NI branch and was its chair from 2018 - 2022.
